Terms of Service

1. Acceptance of Terms

By accessing or using Scholar Track (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you and Scholar Track (“we,” “us,” or “our”). We may update these Terms from time to time; continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Account Creation & Eligibility

To access most features of Scholar Track you must create an account. By creating an account you represent that:

  • You are at least 13 years of age. If you are between 13 and 17, a parent or legal guardian must review and consent to these Terms on your behalf before you use the Service.
  • All information you provide during registration is accurate, current, and complete.
  • You will maintain the security of your account credentials and are responsible for all activity under your account.
  • You will promptly notify us at support@sportscholar.app if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that provide false information or otherwise violate these Terms.

3. Subscription Plans & Cancellation

Scholar Track offers a free tier and paid subscription plans (“Plans”). Paid Plans are billed on a monthly or annual basis as described at the time of purchase. All fees are stated in US dollars and are exclusive of applicable taxes.

Billing. By subscribing to a paid Plan, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are charged at the start of each billing period and are non-refundable except as required by law or as stated in our refund policy.

Cancellation. You may cancel your subscription at any time through your account settings or by contacting support@sportscholar.app. Cancellation takes effect at the end of the current billing period; access continues until that date. We do not prorate partial billing periods unless required by applicable law.

Free Trial. We may offer free trials for paid Plans. At the end of the trial period, your subscription will automatically convert to a paid Plan unless you cancel before the trial ends.

Price Changes.We may change subscription prices at any time. We will provide at least 30 days' notice before a price increase takes effect on your existing subscription.

4. Intellectual Property

The Service and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, software, and the selection and arrangement thereof) are owned by Scholar Track or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Service without our prior written consent.

Your Content.You retain ownership of any profile information, documents, or other content you submit to the Service (“User Content”). By submitting User Content, you grant us a worldwide, royalty-free license to use, store, and display your User Content solely to provide and improve the Service. We will not sell your User Content to third parties.

5. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable federal, state, or local law or regulation.
  • Impersonate any person or entity or misrepresent your identity or affiliation.
  • Upload, transmit, or distribute viruses, malware, or any other harmful code.
  • Attempt to gain unauthorized access to any portion of the Service or its related systems.
  • Scrape, crawl, or use automated means to extract data from the Service without our express written permission.
  • Use the Service for commercial solicitation, spam, or unsolicited advertising.
  • Submit false or misleading academic or athletic information to manipulate scholarship matching results.
  • Interfere with or disrupt the integrity or performance of the Service.

6. Scholarship Data Accuracy Disclaimer

Scholar Track aggregates scholarship, grant, and financial-aid information from a variety of sources and uses automated matching algorithms to generate personalized results. While we strive to keep our database accurate and up to date, we make no warranty or guarantee that:

  • Any scholarship or grant listed on the Service is currently accepting applications.
  • Eligibility criteria, award amounts, deadlines, or other details are current or accurate.
  • A high fit score or probability estimate will result in an award offer.
  • Submission of an application will result in selection or acceptance by the sponsoring organization.

All scholarship and grant decisions are made solely by the sponsoring organization, not by Scholar Track. You must independently verify all program details, eligibility requirements, deadlines, and application procedures directly with the sponsor before applying. Scholar Track is not responsible for any missed deadlines, inaccurate program information, or unsuccessful applications.

7. AI-Generated Content Disclaimer

Scholar Track uses artificial intelligence to assist users with essay drafting, profile suggestions, and other written content (“AI-Generated Content”). By using these features you acknowledge and agree that:

  • AI-Generated Content is a starting point for your own writing — it is not a finished product and may contain inaccuracies, errors, or content that does not reflect your personal voice or experiences.
  • You are solely responsible for reviewing, editing, and verifying any AI-Generated Content before submitting it to any scholarship, college, or other third party.
  • Submitting AI-Generated Content without substantial modification as your own original work may violate scholarship application rules, academic integrity policies, or other terms set by receiving institutions. You are responsible for complying with all such rules.
  • Scholar Track makes no warranty regarding the quality, accuracy, or suitability of AI-Generated Content for any particular purpose.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SPORTSCHOLAR EDGE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUES, LOST DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. IN ALL CASES, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.

9. Indemnification

You agree to indemnify, defend, and hold harmless Scholar Track and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Service; or (d) your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time and for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including Sections 4, 6, 7, 8, 9, 11, and 12.

You may terminate your account at any time by contacting support@sportscholar.app. Termination does not relieve you of any payment obligations that arose before the termination date.

11. Modifications to the Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where required by law, notify you by email or in-app notification. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

12. Governing Law & Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law provisions.

Any legal suit, action, or proceeding arising out of or relating to these Terms must be instituted exclusively in the federal or state courts located in Delaware. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

EACH PARTY WAIVES ITS RIGHT TO A JURY TRIAL WITH RESPECT TO ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
